Terms of Service changelog
This page tracks material changes to the Terms of Service. Minor edits (typo fixes, link corrections, date refreshes) are reflected in the "Last modified" field on the main page and are not separately listed here.
v2.7 — 2026-07-13 — Parties clause: brand-forward, legal entity on request
- §1 (Parties) — the contracting party is now identified as Artifio.ai, a Texas company, with full legal-entity details available on request at legal@artifio.ai. This replaces the prior inline naming of the parent legal entity. The counterparty remains fully identifiable — the change moves the entity's registered name from printed copy to on-request disclosure; it does not change who you are contracting with, your rights, or any obligation.
No other section changed.
v2.6 — 2026-07-10 — Wallet top-ups non-refundable (use-only)
- §6.1 — wallet top-ups are now non-refundable: Balance added by a top-up is for use on the Service only and is not redeemable for cash or refundable to the original payment method. This replaces the previous "refundable for any reason within 14 days on the unspent portion" policy. Two carve-outs are preserved and stated explicitly: (a) mandatory consumer-protection law prevails — EU/UK consumers keep the 14-day right of withdrawal on any unspent portion, and other jurisdictions that compel an unspent-balance refund are honoured; (b) a failed Generation (system error) still restores the charged amount to the wallet Balance automatically — a restoration of Balance, not a cash refund. Balance already spent on Generations remains non-refundable in all cases.
- Checkout — a clear, conspicuous non-refundable notice now appears next to the payment button on the top-up form, linking to §6; completing payment is the customer's affirmative agreement.
This entry changes refund substance. The FAQ "Do you offer refunds?" answer was reconciled to match §6.1 (it previously said top-ups were non-refundable while §6.1 promised a 14-day refund — the two now agree).
v2.5 — 2026-07-10 — $1 bonus eligibility; direct-checkout consent
- §5.2 — adds explicit eligibility conditions for the $1 starter bonus: limited to one per customer and one per unique payment method (the same payment card cannot claim the bonus on more than one account); bonuses from duplicate accounts, duplicate/shared payment methods, or other abuse are ineligible, and Artifio may withhold or reverse the bonus (and the free trial) on detected abuse. The free trial now notes it requires a valid payment method on file, and the trial is offered when starting Gold (no longer tied to a balance top-up).
- §5.3 — documents that, on the streamlined direct checkout, consent to the auto-renewal terms is obtained by a clear-and-conspicuous acknowledgment shown next to the confirmation button (clicking Continue to checkout / completing payment is the affirmative agreement), in addition to the existing un-pre-checked checkbox on other surfaces.
No changes to wallet-withdrawal, refund, or dispute-resolution substance.
v2.4 — 2026-07-09 — Gold trial shortened to 3 days; $1 starter bonus
- §5.2 / §5.3 — the one-time Gold free trial is now 3 days (was 30 days / "first month"). When a customer adds Gold while topping up, the first 3 days are free and the $5.00/month charge begins after the 3-day trial ends. The trial remains available once per customer. The §5.3 ROSCA / CA-ARL free-trial-to-paid disclosure was updated to state the 3-day figure.
- §5.2 — documents the new one-time $1 starter bonus: starting Gold adds $1 to the customer's account balance. The bonus is usable toward generations, is not redeemable for cash, and is not withdrawn if the customer later cancels Gold.
No changes to wallet-withdrawal, refund, or dispute-resolution substance.
v2.3 — 2026-06-24 — Gold first-month-free trial
- §5.2 / §5.3 — documents the one-time "first month free" Gold trial. When a customer adds Gold while topping up their balance, the first month is free (a 30-day free trial) and the $5.00/month charge begins after the trial ends. The trial is available once per customer. §5.3 adds the ROSCA / CA-ARL free-trial-to-paid disclosure (shown and affirmatively consented to at the bundled Gold checkout), parallel to the existing immediate-charge auto-renewal disclosure.
No changes to wallet, refund, or dispute-resolution substance.
v2.2 — 2026-06-23 — Upload affirmation, competing-AI ban, batch arbitration
Four additions, prompted by a competitive review of likeness-handling generation platforms:
- §8.1 — documents the just-in-time "Media upload agreement" we now capture at upload time (rights/likeness + automated-screening affirmation, recorded as a timestamped audit entry).
- §9.4 — new prohibition on using Output/Input Content or derived data to train or build a competing AI model or generative-AI product, or to benchmark for a competing offering.
- §3 — adds an explicit "no ownership in your handle" / username reclamation clause and a standalone electronic-communications consent.
- §19.7 — mass/batch arbitration procedure (batches of ≤50 for 25+ coordinated demands within 90 days); subsequent §19 sub-sections renumbered.
No changes to wallet, Gold, refund, or dispute-resolution substance beyond the new batching mechanism.
v2.1 — 2026-05-17 — §4.7 Coupons clause added
New §4.7 covers promotional discount codes (Coupons) end-to-end:
- Validity windows (start + end date), withdrawal mechanism (
is_activeflag flip) - Per-user redemption limits (default 1) + global redemption caps
- No cash value, no exchange, no transfer between accounts
- One Coupon per transaction (no stacking)
- Artifio's right to withdraw or modify without notice
- Coupon-fraud clause (brute-force / scraping / sharing → account termination + clawback via dispute path)
- Explicit legal characterization (NOT gift cards, NOT gambling, NOT prepaid access devices, NOT securities)
Triggered by the May 2026 coupon system shipping (PR #730 / #732). No material changes to wallet, Gold, or refund terms.
v2.0 — Pre-launch rewrite
Complete rewrite of the Terms for the Artifio.ai launch. v1.0 (December 2024) described the old 5-tier subscription model (Free / Explorer / Professional / Ultimate / Studio) and the legacy "credits" currency. v2.0 replaces those with the live product's wallet + Gold model and adds every launch-critical legal disclosure:
- Wallet + Gold (§4, §5). Dollar-denominated Balance, Top-Up, Generation, and Platform Fee vocabulary throughout. Gold is a $5/month optional membership with a reduced platform fee and priority queue.
- Platform fee disclosure. 20% Standard / 10% Gold, $0.50 minimum per generation, with the tagline A small platform fee keeps your prices unbeatable. published in both the Terms and the checkout flow.
- Refund policy (§6). Wallet top-ups refundable for 14 days on the unspent balance. Gold non-refundable mid-period except the EU 14-day withdrawal right and compelled local-law pro-rata.
- ROSCA-compliant Gold checkout (§5.3). Affirmative, not-pre-ticked consent checkbox displaying the renewal terms verbatim, plus a post-signup acknowledgment email with the same renewal details.
- EU 14-day withdrawal right (§5.5). Article 9 / Article 16(m) of Directive 2011/83/EU. Starting Gold benefits immediately waives the right after partial performance.
- One-click cancellation (§5.4, §7). Cancel from Settings → Membership — no phone, no email, no retention gauntlet. EU users get a cancellation button matching the signup flow from June 19, 2026 per Directive (EU) 2023/2673.
- EU AI Act Article 5 prohibited practices (§9.6). Prohibited uses of AI under Regulation (EU) 2024/1689 (in force February 2025).
- EU AI Act Article 50(4) deepfake disclosure duty (§9.7). The user's obligation to mark AI-generated likenesses of real people.
- TAKE IT DOWN Act (§11.2). 48-hour NCII takedown process (Public Law 119-12, compliance deadline May 19, 2026).
- DSA notice-and-action (§12). Statement-of-reasons, internal-complaint and out-of-court-dispute-settlement rights for EU users.
- 30-day arbitration opt-out (§19.3). Users may email
arbitration-optout@artifio.aiwithin 30 days of first accepting to opt out of binding individual arbitration; the class-action waiver remains. - Indemnification scoped (§18). Enumerated breaches, not mutual-blind, carve-out for Artifio's own unlawful conduct.
- EU/UK liability carve-outs (§16, §17). Statutory warranties and consumer-protection liability that cannot be disclaimed under EU/UK law are preserved.
